5 PROPERTY LISTINGS
We endeavour to ensure that property information published on the Website is accurate and up to date. However, property information may be supplied or updated by Sellers, developers, agents, contractors, or other third parties.
Property information may include:
1 Property prices;
2 Floor plans;
3 Dimensions;
Photographs and videos;
5 Development specifications;
6 Construction dates;
7 Estimated completion dates;
8 Location information;
9 Availability;
10 Payment plans;
11 Financing information;
12 Rental or investment information; and

6 PRICES AND AVAILABILITY
Property prices displayed on the Website may be subject to change. Unless expressly stated otherwise, displayed prices may not include all applicable:

6 Survey fees;
7 Stamp duties;

7 PROPERTY PURCHASES
A User's submission of an enquiry, application, expression of interest, reservation request, or other online form does not automatically create a contract for the purchase of a Property.
A Property purchase becomes binding only when the relevant contractual documentation has been properly executed by the applicable parties and any required conditions have been satisfied. Depending on the transaction, this may include:
1 Reservation documentation;
2 Offer letters;
3 Sale and purchase agreements;
4 Land documentation;
5 Mortgage documentation;
6 Payment schedules;
7 Identification and verification documents; and
8 Other legally required documentation.
8 RESERVATION PAYMENTS
Where a Property is offered with a reservation facility, the applicable reservation amount, payment deadline, cancellation terms, and refund conditions will be communicated to the Buyer before payment where reasonably practicable.
Unless expressly stated otherwise, payment of a reservation amount does not constitute completion of a property purchase.
A reservation may be cancelled or expire where the Buyer:
1 Fails to provide required information;
2 Fails to complete required verification;
3 Fails to make required payments;
4 Fails to execute required documentation;
5 Provides materially inaccurate information; or
6 Otherwise breaches the applicable transaction terms.
Any refund will be handled in accordance with the applicable reservation or purchase agreement and applicable law.
9 PAYMENT METHODS
Payments may be made using payment methods made available on the Website or otherwise communicated by us. You agree to provide accurate payment information and ensure that you have authority to use the payment method provided.
We may use third-party payment processors.
We are not responsible for delays, failures, reversals, additional charges, or service interruptions caused by a third-party payment provider, financial institution, telecommunications provider, or payment network.
We may refuse or delay a transaction where required for security, verification, fraud prevention, regulatory, or legal reasons.
10 FINANCING AND MORTGAGES
Where the Website provides information about mortgages, direct financing, payment plans, instalment arrangements, or other financing products, such information is subject to eligibility and applicable terms.
Unless expressly stated otherwise, publication of financing information does not constitute a guarantee that a Buyer will qualify for financing.

11 BUYER DUE DILIGENCE
Buyers are responsible for conducting appropriate due diligence before purchasing a Property. This may include verifying:

6 Physical condition;
7 Location;
8 Access;
9 Utilities;
10 Development restrictions;

Buyers should obtain independent professional advice, including legal, valuation, surveying, tax, financial, and planning advice where appropriate.
12 SELLER REPRESENTATIONS
A Seller listing a Property through the Website is responsible for ensuring that information supplied by the Seller is accurate, lawful, and not misleading. The Seller must have the legal authority to market and sell the Property.
The Seller must promptly notify us of any material change affecting a Listing, including changes to:
1 Price;
2 Availability;
3 Ownership;
4 Legal status;
5 Property specifications;
6 Completion date; or
7 Any material defect or restriction.
We reserve the right to remove, suspend, modify, or reject a Listing where we reasonably believe that it may be inaccurate, unlawful, misleading, fraudulent, or otherwise inappropriate.
13 THIRD-PARTY SELLERS AND DEVELOPERS
Where a Property is owned, developed, marketed, or supplied by a third party, the third party may remain responsible for:
1 Construction;
2 Property completion;
3 Title;
4 Delivery;
5 Property condition;
6 Warranties;
7 Defects;
8 Maintenance;
9 After-sales services; and
10 Other obligations specified in the relevant transaction documents.
The applicable sale agreement will determine the respective obligations of the parties.
14 PROPERTY VIEWINGS
Where viewing appointments are offered, Users must comply with reasonable instructions provided by us, the Seller, developer, agent, property manager, or other authorised person.
Users must not:
1 Damage Property;
2 Remove items;
3 Enter restricted areas;
4 Take unauthorised photographs or recordings;
5 Interfere with construction or operations; or
6 Put themselves or others at risk.
We may cancel or reschedule a viewing where necessary.
15 USER ACCOUNTS
Certain Website functions may require you to create an account.
You are responsible for:
1 Providing accurate information;
2 Keeping your login credentials confidential;
3 Maintaining the security of your account;
4 Updating inaccurate information; and
5 All activity occurring through your account, subject to applicable law.
You must notify us promptly if you believe your account has been accessed without authorisation.

24 DISCLAIMERS
To the maximum extent permitted by applicable law, information provided through the Website is provided for general informational and property transaction purposes.
You should not rely solely on Website information when making a significant property, legal, financial, investment, or tax decision.
Nothing on the Website constitutes legal, tax, valuation, investment, or financial advice unless expressly identified as such and provided by an appropriately authorised professional.
25 LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of the Website or Services.

Nothing in this section prevents a party from seeking urgent legal or injunctive relief where appropriate.
32 CONSUMER RIGHTS
Nothing in these Terms is intended to exclude, restrict, or limit any mandatory consumer rights or statutory protections that cannot lawfully be excluded or limited.
Where applicable law provides Users with rights that are more favourable than these Terms, those rights will continue to apply.
33 SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
34 NO WAIVER
Failure by us to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.
35 ENTIRE AGREEMENT
These Terms, together with any applicable policies, property-specific terms, reservation agreements, sale agreements, financing agreements, and other contractual documents, constitute the applicable agreement concerning your use of the Website and Services.
Where a separate written agreement relating to a Property transaction conflicts with these Terms, the specific transaction agreement will generally prevail with respect to that transaction.
